Until recently, Visalia has been banned from selling or growing cannabis. However, a new state law called SB 1186 has forced the city to change its laws and allow delivery-only medical cannabis businesses in order to comply with state regulations.

These cannabis businesses can only sell to individuals who have a physician’s recommendation and possess a valid California medical marijuana card. The businesses must also follow specific and strict legal guidelines in order to avoid criminal prosecution for violating the state’s Compassionate Use Act.

According to the City of Visalia’s Community Development Director Paul Bernal, the city would be able to limit the number of delivery-only cannabis businesses, impose security plans on the business sites, require them to have licensed drivers and inspect their vehicles, and require that the business sites are not within 500 feet of schools inside or outside the city limits.

Councilman Greg Collins believes the city could even impose an 8% tax on cannabis sales to help local businesses and provide funding for police, fire, emergency services, and parks. He fears if the city does not take this action, residents will continue traveling to nearby pot-friendly cities to meet their cannabis needs.
